FOR PEOPLE Privacy Policy

We understand the special importance of protecting your personal data, therefore we collect and process only your data that is necessary for the performance of our activities. We process personal data lawfully, transparently and fairly, for predetermined purposes and only to the extent necessary to achieve the purposes. When processing personal data, we strive to ensure that it is accurate, secure, confidential, properly stored and protected.

When processing your personal data, we comply with the requirements for processing personal data set out in the General Data Protection Regulation (hereinafter referred to as the GDPR), the Law on Legal Data Protection of the Republic of Lithuania, and the Norwegian "Personopplysningsloven" (2018 no. 38), as well as other legal acts.

The Privacy Policy applies to all people whose data we process.

1. HOW DO WE COLLECT YOUR PERSONAL DATA?

1.1. We process your personal data obtained in the following ways:
a) When you provide it to us. You provide us with your personal data when you send us your CV, cover letters, apply for our job advertisements on job search portals, register on our websites, communicate with us by phone, e-mail or during meetings, respond to questionnaires provided by us, complete tasks or tests, contact us via social networks (e.g. Facebook, LinkedIn, Instagram), use the Messenger chat app integrated into the website, share your success stories and provide feedback about us. When you contact us in writing or electronically, we will save the correspondence data.
b) When you use the websites operated by us. When you use the websites operated by us, certain information (e.g. internet address (IP), device used, web browser used, number of visits, pages of our website viewed, time spent on the website, websites you visited before accessing our website) is collected automatically.
c) When we receive your personal data from other people in accordance with the procedure established by law and/or this Privacy Policy.

1.2. We may combine the personal data we receive from you with data we collect from other public or accessible sources. For example, we may combine the personal data you provide with data collected using website cookies, data collected when you provide our services, or data legally obtained from third parties. When exercising your rights, you can always request the correction of incorrect personal data.

2. FOR WHAT PURPOSES AND BASES DO WE PROCESS YOUR DATA?

2.1. Your personal data is processed in accordance with the following main grounds for processing personal data set out in the GDPR:
a) In order to perform a contract or in order to take steps at the request of the data subject prior to entering a contract.
b) With the consent of the data subject.
c) When processing the data it is necessary for compliance with a legal obligation to which we are subject.
d) When processing personal data is necessary for the legitimate interests pursued by us or by a third party.

2.2. We process your personal data for the following purposes:
a) For the purpose of providing services. We process your personal data to provide our services – employment and temporary staffing (staff leasing) services for employees from Lithuania and other European countries sent to work in Norway at MB FOR PEOPLE NUF client companies. For you and other people: to find and select candidates who meet the needs of our clients, to assess whether the candidates are suitable for the job offered, and to introduce the candidates to employers or to employ them in your company.
For this purpose, we process your personal data obtained from you (e.g. data provided in your CV, data collected during communication and other data necessary for employment, your name, surname, company you work for, telephone number, e-mail - when you represent a company applying for services), collected when you use our and other websites and (or) received from other persons (e.g. recommendations from current or former employers or acquaintances, social networks, mass media, etc.). If you apply for a job and give your consent, we process the following personal data of yours:
1. Identification and contact data: name, surname, year of birth, gender, age, e-mail address, telephone number, Messenger/ MS Teams / WhatsApp/ Viber/ Google Meet name, residential address, address type (home, work), country, city;
2. Needs: desire to travel as a couple, working conditions (full-time job, flexible or shift work, salary expectations), bad habits, preferences (field of work, position, location, start of work, other);
3. Information for assessing suitability: CV data, job sought in Lithuania and/or abroad, citizenship, language skills, residence/work permit in the European Union, European Economic Area (EEA), study data (type, status), education (acquired profession, specialty, additional qualifications), work experience (company, duties, period of work, nature of work, responsibilities, reasons for leaving, other jobs, work experience in various conditions, work abroad), possibilities of traveling to work by car, personal characteristics, when required by the specifics of the workplace, we process health data (health disorders, allergies, limitations in working capacity) to assess suitability;
4. Motivation: recommendations, reasons for going abroad, desired job, important aspects at work, duration of the job sought, possibility of going abroad quickly, data on whether there are relatives who need to be taken care of in Lithuania, coordination of trips with the family;
5. Competencies: qualifications and certificates confirming them (possession of a valid forklift license, possession of driving category rights), test results;
6. Individual communication information: IP code and IP address of the email sender's server, interview data (date, person who planned it, person who conducted the survey), planned interviews (date, time, person who registered, notes), data source (where the data was obtained from, name of the source, date of data receipt, person who entered the data).
By giving us your consent to the processing of personal data, you confirm that:
● You provide accurate and correct Personal Data, and if these change, you will immediately inform MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway);
You will provide data of other persons to MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway) only after receiving their consent in accordance with the procedure established by law;
Before giving consent, you asked questions of concern regarding the processing of Personal data to MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway) and they were answered.
For this purpose, we provide or transfer your data to our partners and clients - employers who are looking for employees. Together with us, they will be the controllers of your personal data. We will not transfer more of your personal data to clients than we will process on the basis of this Privacy Policy. We have concluded agreements with clients under which both parties undertake to protect your personal data. For this purpose, we process your data while the service is provided to you. If your personal data is processed in the course of providing services to other persons, with your consent, we process your personal data for 3 years from the date of receipt of your consent. After that, we will securely destroy Personal Data, for which we will have no legal basis to process, except for information confirming the fact of your consent, which we will store for no longer than 10 years in order to assert, exercise or defend legal claims of MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway).
When providing services, with your consent, we may conduct your (candidate's) assessments. We will process the results of tests and assessments until a specific selection is carried out or, with your consent, for a longer period specified in this Privacy Policy for the purpose of administering the candidate database.
b) For the purpose of administering the candidate database. After the specific selection for the job for which you provided your data has been completed, with your consent, we process your personal data in order to be able to offer you future employment and career opportunities, to find and select candidates who meet the needs of our clients, to assess whether candidates are suitable for the offered job, and to introduce candidates to employers.
For this purpose, we process the same personal data as for the purpose of providing services, provide them to the same people and store them for 3 years from the date of receipt of your consent.
c) We also process the data of your recommended person for the purpose of selection for a job offered by us or our partners, and your (the recommender's) personal data for the purpose of administering the bonus for the recommended person.
For this purpose, we process the following data of the recommended person: name, surname, phone number, e-mail address, work experience, characteristics, talents, other information provided, data of the recommender: name, surname, phone number, e-mail address, data necessary for the payment of the bonus, IP address of the server of the e-mail sender, IP address of the device from which the e-mail was sent, data source (where the data was received, name of the source, date of receipt of the data, person who entered the data).
We will process the data of the recommended person for 3 years from the date of consent to participate in the selection. We will process the data of the recommender during the selection process of the recommended person (if the recommended person is not employed) or for 3 years after the payment of the bonus (if the recommended person is employed).
We will transfer the recommended person's data provided by you regarding successful/unsuccessful selection for the job for which the person was recommended, employment/non-employment, and work on the project during the period required to receive the bonus to the recommending person for the purpose of administering the bonus for the recommended person.
For the purpose of selection for a job offered by MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway) and/or its partners, MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway) may transfer the personal data of the recommended person specified by you to potential employers worldwide, including those located in countries whose legislation does not ensure the level of legal protection of personal data in force in Lithuania and Norway. When transferring personal data to a recipient in such a country, MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway) and the recipient of personal data will apply appropriate security measures to protect personal data from unlawful processing. We may also transfer the personal data specified in the consent to the minimum necessary extent to a third-party providing services to MB FOR PEOPLE (Lithuania) or MB FOR PEOPLE NUF (Norway), including legal, tax, business or personnel administration, accounting advisors and to state institutions competent in accordance with the procedure established by law.
d) For the purpose of quality control of services (recording of telephone conversations). When you call us or we contact you, we sometimes record our conversation to ensure the quality of service and control the provision of services.
For this purpose, we process the following personal data of yours: name, surname, telephone number, recording of the telephone conversation (data provided during the conversation), date and time of the telephone conversation, name, surname of the person advising you.
For this purpose, we receive your personal data from you or create it when you use our services. For this purpose, we store your data for 3 years.
e) In order to administer the work activities of employees. To the extent that we are obliged or permitted to do so by law, we process the personal data of our employees in accordance with the procedure set out in our internal rules.
f) For the purpose of improving the websites we manage and to offer you better and more tailored services. We use your personal data, including personal data that we receive when you use our websites, to improve and develop these websites and to offer you better and more tailored services. For this purpose, we use your personal data obtained from you, obtained when you use our websites and obtained from other people. For information on how we use cookies and similar technologies, please read Section 3 of this Privacy Policy.
g) For the purpose of direct marketing. By completing and submitting the form on the website www.darbasuzsienyje.eu, you consent to the storage and processing of the personal data you provide to provide you with our services, the services of persons associated with us and our partners, and to improve our services.

For this purpose, we process your personal data that you provide when contacting us via the Messenger chat app, leaving feedback about us or sharing your success story in the feedback section of the website. For this purpose, we process your personal data such as e-mail address, your name on Facebook, the text of the feedback, success story, and request text.
For this purpose, we process your data in correspondence for 1 year from the start of the correspondence. We also process your personal data that you provide when communicating with us using Messenger, Viber, MS Teams, Google Meet or WhatsApp apps for the specified purpose. For this purpose, we process your personal data such as phone number, information provided during correspondence, your name on Messenger, Viber, MS Teams, Google Meet or WhatsApp apps.
We store the history of correspondence for 1 year from the beginning of the correspondence. We also conduct virtual meetings in Viber, Google Meet, MS Teams, WhatsApp and Messenger applications to promptly carry out our activities and replace physical meetings with virtual ones. We do this to ensure communication with potential employees, Company employees and partners. You can find out
how Messenger, Viber, Google Meet, WhatsApp or MS Teams processes your personal data in the privacy notices published by these applications.

2.3. When your personal data is processed with your consent, if you withdraw your consent or after the expiration of the consent period, your personal data will no longer be processed, except for the storage of data confirming the fact of giving consent for a period of no longer than 10 (ten) years in order to assert, exercise or defend our legal claims.

2.4. We do not process your personal data for any other purposes incompatible with the purposes listed above.

3. HOW DO WE USE COOKIES?

3.1. We collect information about you using cookies and similar technologies. 4. WHO DO WE PROVIDE YOUR PERSONAL DATA TO?

4.1. We guarantee that your personal data will not be sold, provided or otherwise transferred to third parties without a lawful basis, as well as used for purposes other than those for which they were collected. We will not transfer your personal data in any way other than in accordance with this Privacy Policy and legal acts. However, we reserve the right to provide information about you if we are obliged to do so by law or if we are required to do so by legally acting authorities or criminal prosecution authorities.

4.2. For the purposes specified in this Privacy Policy, we may transfer your personal data to companies that help us carry out our activities (partners, customers, suppliers). We require such partners to process your data only in accordance with our instructions and applicable legal acts ensuring the protection of your data. We conclude contracts with these people that oblige the parties to strictly comply with personal data protection requirements.

4.3. The ability of the above service providers to use your data is limited - they cannot use this data for purposes other than providing services to us.

4.4. A non-exhaustive list of people and their categories to whom we transfer your personal data is provided in clause 2.2 of this Privacy Policy separately for each purpose of using personal data.

5. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

5.1. We store your personal data for no longer than required for the purposes of data processing or provided for by legal acts, if they establish a longer data storage period.

5.2. We strive not to store outdated, irrelevant personal data, therefore, when updating it (e.g., by updating the account, changing information, etc.), only relevant information is stored. Historical information is stored if it is necessary in accordance with the procedure established by law or for the performance of our activities.

6. HOW DO WE PROTECT YOUR PERSONAL DATA?

6.1. The data we collect from you will be processed in the European Union and the European Economic Area (EEA), including data transfers between Lithuania and Norway. As both countries are part of the EEA, such transfers are considered secure under Article 45 of the GDPR. If data is transferred outside the EEA, we will apply standard data protection clauses approved by the European Commission.

6.2. Unfortunately, the transmission of information over the Internet is not completely secure. Although we make every effort to protect your personal data, we cannot guarantee the security of your data when you transmit data to websites - you assume the risk associated with the transmission of data to websites. Once we receive your data, we will apply strict procedures and security measures to protect your data from unauthorized access.

6.3. If, in the unlikely event of a breach of your personal data, we become aware of a breach of your personal data that is likely to pose a significant risk to your rights or freedoms, we will notify you immediately upon becoming aware of it and determining what information has been accessed.

6.4. In the event of a personal data breach, we will notify the relevant supervisory authority (VDAI or Datatilsynet) no later than 72 hours after becoming aware of the breach and, if necessary, inform the affected individuals.

7.1. The Websites may contain links to external websites, such as those of our business partners or websites that advertise our services. When following such links to any of the websites, please note that these websites and the services accessed through them have their own separate privacy policies and we are not responsible or liable for these policies or for the personal data collected on these websites or while providing the services, such as contact or location data. Please review these policies before providing any personal data on these websites or using any of the services.

8. WHAT RIGHTS DO YOU HAVE?

8.1. When processing personal data, we ensure your rights under the GDPR, the Law on the Legal Protection of Personal Data of the Republic of Lithuania and Norway. As a personal data subject, you have the following rights:
a) to know (be informed) about the processing of your personal data;
b) to get acquainted with your personal data that we process;
c) demand correction or addition, clarification of incorrect, inaccurate, incomplete personal data of yours.
d) demand destruction of personal data when it is no longer necessary for the purposes for which they were collected.
e) demand destruction of personal data if they are processed unlawfully or when you withdraw your consent to the processing of personal data or do not provide such consent, and it is necessary.
f) object to the processing of personal data or withdraw previously given consent.
g) withdraw the consents given to the processing of personal data when personal data are processed for specific purposes on the basis of your consent.
h) demand suspension (except for storage) of the processing of your personal data if disputes arise or it is necessary to verify the lawfulness of data processing, the accuracy of the data, as well as in cases where we no longer need your personal data, but you do not want us to destroy them.
i) demand provision, if technically feasible, of your personal data collected in accordance with your consent or for the purposes of performing the contract in an easily readable format or request their transfer to another data controller.

8.2. We will strive to guarantee the implementation of your rights as a personal data subject and create all conditions for the effective implementation of these rights; however, we reserve the right not to comply with your requirements when it is necessary to ensure:
a) the performance of legal obligations imposed on us.
b) national security or defense.
c) public order, prevention, investigation, detection or prosecution of criminal acts.
d) important economic or financial interests of the state.
e) prevention, investigation and detection of violations of official or professional ethics.
f) protection of your rights and freedoms or those of other people.

8.3. You may submit requests to us in person, by post or by electronic means of communication related to the exercise of your rights. Upon receipt of your request, we may request that you provide identification documents, as well as other additional information related to the request that we may need.

8.4. Upon receipt of your request, we will respond to you no later than within 30 calendar days from the date of receipt of your request and submission of all documents required for the response.

8.5. If we consider it necessary, we will suspend the processing of your data, except for storage, until your request is resolved. If you lawfully withdraw your consent, we will immediately, but no later than 30 calendar days, terminate the processing of your personal data, except for the cases specified in clause 8.2. of this Privacy Policy and legal acts, i.e. when we are obliged to continue processing your data by applicable legal acts, legal obligations to which we are subject, court decisions or mandatory instructions given to us by institutions.

8.6. If we refuse to comply with your request, we will clearly state the grounds for such refusal.

8.7. If you disagree with our actions or response to your request, you may complain about our actions and decisions to the competent state authority, in Lithuania - the State Data Protection Inspectorate (VDAI), in Norway - the supervisory authority - Datatilsynet ( www.datatilsynet.no ).

9.3. If you believe that your rights under the GDPR have been violated, you may file a complaint with our supervisory authority, the Lithuanan Data Protection Authority, or in Norway, the Datatilsynet, although we will first and foremost try to resolve any disputes with you.

10. HOW WILL THIS PRIVACY POLICY BE CHANGED?

10.1. Any changes to our Privacy Policy will be posted on the website. If necessary, we will notify you of them. New Privacy Policy terms may also be posted on the websites, and you may be required to read and agree to them in order to continue using the website and/or our services. This Privacy Policy is prepared in Lithuanian and is available in Russian and English. In the event of any inconsistencies between the language versions, the Lithuanian version shall prevail.
